DRAFT FOR LEGAL REVIEW — NOT FINAL LEGAL ADVICE.
1. Marketplace Role
CintaMart provides an online marketplace through which independent vendors may list and sell products to buyers.
Unless expressly stated otherwise, products are supplied by the vendor identified in the relevant listing or order.
2. Product Information
Vendors are responsible for providing accurate product descriptions, pricing, availability and other listing information.
CintaMart may review, moderate, suspend or remove listings that violate marketplace requirements.
3. Prices and Payments
The price displayed to the buyer is the amount payable for the relevant goods and applicable marketplace charges, delivery charges and other amounts shown before checkout.
Payments are processed through approved payment infrastructure.
A buyer should review the complete order total before authorising payment.
4. Orders
An order is not considered successfully paid until CintaMart receives confirmation from the applicable payment-service provider.
CintaMart may cancel or reverse transactions where required because of payment failure, fraud, duplicate transactions, product unavailability, legal requirements or other legitimate marketplace reasons.
5. Delivery and Receipt Confirmation
The buyer should inspect an order promptly after delivery.
Where CintaMart provides a delivery-confirmation feature, the buyer may be asked to confirm receipt.
If the buyer does not confirm receipt or open an eligible dispute within the applicable period after the vendor marks the item delivered, CintaMart may automatically treat delivery as confirmed according to the marketplace's current delivery-confirmation rules.
A pending return, refund or dispute may prevent automatic confirmation where applicable.
6. Returns, Refunds and Disputes
Returns and refunds are subject to CintaMart's applicable Refund and Return Policy, the nature of the product, the reason for the request, applicable vendor obligations and applicable law.
Buyers should raise problems promptly through the mechanisms provided on the platform.
7. Accounts
Buyers are responsible for providing accurate account information and maintaining the security of their credentials.
Accounts must not be used for fraud, abuse, unauthorised transactions or unlawful activity.
8. Vendor Independence
Vendors operating on CintaMart may be independent businesses.
CintaMart may establish marketplace standards and administer transactions without becoming the manufacturer of every product offered through the platform.
Counsel should refine the legal allocation of responsibility in this section.
9. Prohibited Conduct
Buyers must not use CintaMart to:
- engage in fraud;
- manipulate transactions;
- abuse refund or dispute systems;
- compromise another user's account;
- interfere with the platform;
- purchase prohibited goods;
- violate applicable law.
10. Privacy
Personal information is handled according to the CintaMart Privacy Policy.
11. Changes
CintaMart may revise these Marketplace Terms. Material revisions may require renewed acknowledgement where appropriate.
